Agreement to Terms

By accessing and using the Chivshyx website (Chivshyx.world) and services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not use our website or services.

Services Description

Chivshyx provides custom embroidery services, including but not limited to:

  • Satin stitch embroidery
  • Ribbon embroidery
  • Cross-stitch work
  • Clothing embroidery with ethnic and contemporary motifs
  • Home décor items
  • Portrait and landscape embroidery
  • Embroidery consultations and lessons

Consultation and Booking

Consultation Process

Initial consultations are provided to discuss project details, materials, design, timeline, and pricing. Consultations may be conducted in-person, via phone, or video call as agreed upon.

Booking and Deposits

Once a project is agreed upon, a non-refundable deposit of 50% of the total project cost is required to secure your booking and commence work. The remaining balance is due upon project completion before item collection or delivery.

Cancellations

If you need to cancel your project after work has commenced, the deposit is non-refundable as materials will have been purchased and time invested. Projects cancelled before work begins may be eligible for a partial refund, minus any materials already purchased.

Project Timelines

Project completion timelines are estimates provided in good faith. While we strive to meet all agreed-upon deadlines, complex projects may occasionally require additional time. We will notify you promptly of any delays and provide updated timelines.

Materials and Design

Material Selection

We will provide guidance on material selection, but final material choices must be approved by you before work begins. Once approved and purchased, materials cannot be changed without potential additional costs.

Design Approval

Design mockups or sketches will be provided for your approval before embroidery work begins. Any changes requested after approval and commencement of work may incur additional charges and extend project timelines.

Custom Designs

All custom designs created for your project remain your property for the specific commissioned piece. However, we retain the right to photograph completed work for portfolio and promotional purposes unless otherwise agreed in writing.

Pricing and Payment

All prices are quoted in US Dollars (USD). Payment methods accepted include:

  • Bank transfer
  • Cash (in-person transactions)
  • Credit/Debit card

Full payment must be received before completed items are released for collection or delivery.

Quality and Workmanship

We take pride in the quality of our work and ensure all pieces meet high standards of craftsmanship. If you are not satisfied with the finished product, please notify us within 7 days of collection. We will assess the issue and work with you to resolve any legitimate concerns.

Care Instructions

Detailed care instructions will be provided with all completed items. Proper care is essential to maintain the quality and appearance of embroidered pieces. We are not responsible for damage resulting from improper care or cleaning.

Customer-Supplied Items

If you provide items (such as clothing or fabric) for embroidery:

  • Items must be clean and in good condition
  • We are not responsible for any existing defects or damage to supplied items
  • We will take reasonable care of your items, but cannot be held liable for damage that may occur during the embroidery process
  • We recommend not providing items of significant sentimental or monetary value

Intellectual Property

Copyright

You must have the legal right to use any designs, logos, or artwork you provide for embroidery. You warrant that your use of such designs does not infringe on any third-party intellectual property rights.

Portfolio Use

Unless otherwise agreed in writing, we reserve the right to photograph and display completed work in our portfolio, website, and marketing materials.

Limitation of Liability

To the maximum extent permitted by law, Chivshyx shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the amount paid for the specific service in question.

Force Majeure

We shall not be held liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, government restrictions, or supplier delays.

Dispute Resolution

In the event of any dispute arising from these terms or our services, both parties agree to first attempt to resolve the matter through good faith negotiation. If resolution cannot be reached, disputes shall be governed by the laws of Kentucky, United States.
